Terms of Service

Hestasales is a marketplace brand and service operated by Oskar Fornstedt AB (org. no. 559561-1020, VAT SE559561102001), registered in Sweden, with registered address Bemersberg 3, 743 82 Bälinge, Sweden.

Oskar Fornstedt AB is the provider of the Hestasales platform and your contractual counterparty for the Hestasales platform service.

• "Platform" — the Hestasales websites, mobile web experience, accounts, listings, and related functionality.
• "User" — any person or entity who accesses or uses the Platform.
• "Seller" — a user who submits or publishes a listing.
• "Buyer" — a user who browses or contacts a seller.
• "Listing" — an advertisement for a horse or pony of any breed, or a stallion catalogue entry, published on the Platform.
• "Business seller" — a seller acting for purposes relating to their trade, business or profession.
• "Private seller" — a natural person selling outside their trade, business or profession.

• Browsing publicly available listings has no age restriction.
• You must be at least 13 years old to create an account.
• Users aged 13–17 may create and use a buyer account only with the approval of a parent or legal guardian, and may only use ordinary buyer functionality.
• You must be at least 18 years old to create or submit a listing, to act as a private or business seller, to represent a company or other legal entity, or to accept the Seller Rules.
• A parent or guardian who wishes to advertise a horse must create and operate the seller account in the adult's own name.

To use authenticated features you must create an account and provide accurate information, including an age-band declaration and, where applicable, a guardian-approval declaration.

You must accept these Terms and acknowledge the Privacy Policy before creating an account.

• Keep your credentials confidential.
• You are responsible for activity on your account until you notify us of unauthorized use.
• Do not share, sell or transfer your account.
• Contact us if you believe your account has been compromised.

Hestasales publishes advertisements for horses and ponies of all breeds and provides a stallion catalogue. The Platform allows browsing of approved and available listings, allows registered sellers to submit listings for moderation, and lets authenticated users retrieve seller-selected contact methods for approved, active and unsold listings, subject to the Platform’s access rules.

Hestasales provides an internal messaging service for communication between users, subject to the Platform’s access rules. Users can also communicate through the external contact methods the seller has chosen to make available.

Hestasales:

• operates the advertising and contact platform;
• does not own advertised horses;
• is not the seller or buyer, and is not a party to the horse purchase agreement;
• does not process, receive, hold or transfer payments for horses;
• does not create or sign the final horse purchase agreement;
• is not a broker, estate agent, veterinarian, inspector, insurer, escrow provider or payment provider;
• does not inspect horses;
• does not verify seller identity, ownership, pedigree, health, suitability, behaviour or legal status of a horse;
• does not guarantee that every listing or seller statement is accurate;
• may review, reject, suspend, archive or remove listings, and may request documentation.

Moderation is a review of listing form and obvious rule compliance. It is not a veterinary examination, ownership check, identity verification, pedigree verification or guarantee of accuracy.

• Verify seller identity and horse information independently.
• Inspect the horse in person and request appropriate documentation.
• Consider an independent veterinary examination.
• Use an appropriate written purchase agreement.
• Arrange payment and transport directly with the seller.

Sellers must comply with the Seller Rules. At listing submission the seller must confirm they are at least 18 years old, have the legal authority to advertise the horse, and that the listing information is accurate.

For every listing, the seller must declare whether they act as a private seller or a business seller. Business sellers must provide legal business name, organisation or registration number, country of registration, business postal address, business contact email, and VAT number where applicable. This information is displayed on the listing.

Hestasales does not classify sellers automatically. A truthful self-declaration is required. Hestasales does not describe a business seller as "verified" unless an actual verification process has been completed.

Mandatory consumer-protection rules may apply where a business sells to a consumer. Those rules apply as a matter of law and are not created or waived by these Terms.

Listings are reviewed before publication. Hestasales may reject, suspend, edit or remove a listing that violates these Terms, the Seller Rules or applicable law, or that appears fraudulent, misleading or otherwise harmful.

Material changes to a listing's seller type or business identity return the listing to pending review before the changed version becomes public.

• Anonymous visitors do not see seller contact information.
• Authenticated users may retrieve seller-selected contact methods for an approved, active and unsold listing.
• Listing owners and authorized administrators may access contact information where necessary.
• Contact information is not returned in bulk feed queries.

You must not:

• post false, misleading, duplicate or fraudulent listings;
• misrepresent horse identity, ownership, health, pedigree, age or price;
• upload content you do not have the right to use;
• harass, threaten or defame other users;
• upload malware or attempt to breach platform security;
• use the Platform for unlawful purposes or in violation of animal-welfare law;
• attempt to evade moderation or reporting mechanisms.

Any user, whether logged in or not, may report a listing or other illegal or prohibited content through the "Report this listing" button on a listing page, the "Report illegal content" footer link, or by emailing org.hestasales@gmail.com.

Hestasales will assess reports in good faith, may request further information, may restrict or remove content, and may preserve records where legally necessary. Not every report results in removal.

Hestasales may suspend or terminate access, or remove listings, where a user materially breaches these Terms, applicable law, or where required to protect the Platform or other users. A user may request account deletion through the in-app deletion workflow.

The Hestasales name, logo, text, layout and platform code are owned by Oskar Fornstedt AB or its licensors and are protected by intellectual-property laws. No part of the Platform may be copied, modified or distributed outside normal browsing use without written permission.

You retain ownership of the text, images and videos you upload. You grant Oskar Fornstedt AB a worldwide, non-exclusive, royalty-free licence to host, display, cache, moderate and distribute that content through the Platform solely to operate, promote and protect the Platform. You may withdraw this licence by removing the content or deleting your account, subject to backups and legal-record retention described in the Privacy Policy.

The Platform is provided on an "as available" basis. Hestasales may change, restrict or discontinue features at any time. Planned interruptions and maintenance may occur without notice.

The current basic Hestasales marketplace service is free of charge. If Hestasales introduces paid features, the price and separate terms will be presented before you subscribe or purchase.

Hestasales does not guarantee the accuracy, completeness, safety, legality or outcome of any listing, communication or transaction.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, personal injury where such exclusion is prohibited, or any other liability that cannot lawfully be excluded.

Subject to the paragraph above, Oskar Fornstedt AB's aggregate liability arising out of or relating to the Platform is limited to the greater of (a) the total fees you paid to Oskar Fornstedt AB for the Platform in the 12 months preceding the event, or (b) EUR 100.

If you use the Platform as a consumer, you keep all mandatory rights under Swedish and EU consumer-protection law. Nothing in these Terms removes those rights.

Processing of personal data is described in the Privacy Policy. Oskar Fornstedt AB is the data controller for personal data processed for the operation of Hestasales, unless a specific processing activity has a different verified legal role.

These Terms are governed by Swedish law, without prejudice to mandatory consumer-protection rules of the country where the consumer resides.

Disputes shall be brought before the competent Swedish courts. Consumers resident in Sweden may also contact the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), Box 174, 101 23 Stockholm, arn.se. ARN decides in its sole discretion whether to accept a case.

Material changes to these Terms will be notified in-app or by email and, where appropriate, will require re-acceptance before continued authenticated use. Non-material changes take effect on publication.
